Employee Misconduct

Mr. Peck was engaged by a financial institution to assist with the termination of a system administrator who had been sexually harassing other employees by sending pornography via corporate email. Due to the sensitive nature and danger posed to the systems, a plan was developed to facilitate an investigation and to remove the administrator’s access while preserving evidence.

Mr. Peck arrived at the institution under the guise of conducting an IT audit, which is required by the Gramm-Leach Bliley Act to meet compliance. Mr. Peck determined all levels of access the administrator had and worked with legal to devise an exit strategy for the administrator. The administrator’s account was immediately deactivated, passwords changed and the laptop seized. Subsequent forensic examination revealed suspected child pornography, which halted the investigation and was immediately turned over to local authorities.
